FBK-ISR International Seminar 2023
The widespread affirmation of the Internet in many sectors of private activity has contributed decisively to transforming the relationships between people, as well as between people and public institutions. It helped eliminating borders, building new systems of production and contributed to the creation of a more open and free society.
Considering the importance and pervasive potential of the Internet, a “Study Commission on the rights and duties relating to the use of the Internet” has been set up at the lower house of the Italian Parliament, chaired by Stefano Rodotà. Its work has resulted in a document containing the so-called “Declaration of Rights on the Internet”, approved by the European Commission and published on 28 July 2015. Article 9 of the Declaration of Rights on the Internet, with regard to the protection of the right to personal identity, provides that:
1. Everyone has the right to a complete and up-to-date representation of their identity on the web.
2. The definition of identity concerns the free construction of the personality and cannot be removed from the intervention and knowledge of the person concerned.
3. The use of algorithms and probabilistic techniques must be brought to the attention of those concerned, who in any case may oppose the construction and dissemination of profiles that concern them.
4. Each subject has the right to provide only the data strictly necessary for the fulfillment of legal obligations, for the supply of goods and services, for access to platforms operating on the Internet.
5. The attribution and management of the digital identity by Public Institutions must be accompanied by adequate guarantees, in particular in terms of security
